State of Colorado 3/17/2016 <br /> Division of Reclamation, Mining and Safety <br /> 1313 Sherman St, Rm215 <br /> Denver, Co 80203 <br /> Dear Mr. Cunningham: <br /> I am seeking DRMS approval to open the Puma City mine for exploration and <br /> prospecting. While reading the information pertaining to filling a NOI, the definition <br /> of "Prospecting"is defined, then on page iii..."The term does not include any <br /> single activity which results in the disturbance of a single block of land totaling <br /> 1600 square feet or less of the land surface, not to exceed two such disturbances <br /> per acre..." It appears that the law provides for exceptions to low impact actions. As my <br /> impacts will be limited to 12 square feet (on top of a tailings pile) to open the adit <br /> sufficient for entry, and even if adding the foot trail (561 square feet - though it falls <br /> within the "causes no greater land disturbance than is caused by the ordinary, <br /> lawful use of the land by persons not prospecting"exception) it is still well under <br /> that threshold. Therefore, my first option is to request an exemption from the Notice-Of- <br /> Intent process. <br /> As I am planning a prospecting trip in May, I am also submitting NOI forms (attached), <br /> and check, for consideration.
