(Tri-State) is the parent company of <br />Western Fuels -Colorado, A Limited Liability Company (WFC) New Horizon North Mine. The New <br />Horizon North Mine operates under the Division of Reclamation, Mining and Safety (Division) Permit <br />No. C-2010-089. <br />In accordance with Rule 4.18(3)(a), Tri-State on behalf of the New Horizon North Mine is <br />providing written notification to the Division of a possible Bald Eagle nesting location approximately <br />600' north of the active pit. New Horizon North Mine personnel verbally notified the Division during the <br />Division inspection that occurred on February 16 and 17, 2016. The site personnel also physically <br />showed the Division during that inspection the possible nesting location. <br />Tri-State notified the United States Fish and Wildlife Service (USFWS) Migratory Bird Division <br />of the potential nesting location on January 20, 2016. Tri-State has also applied for a "Permit for <br />Application of an Eagle Take Associated With But Not The Purpose of An Activity (Disturbance) " on <br />February 4, 2016, with the USFWS to mitigate the issue. At this time the permit issuance is still pending <br />with the USFWS.
