<br />Pursuant to the Rules and Regulation of the
<br />Colorado Mined Land Reclamation Board pub
<br />lished August 1980, and pursuant to the Colorado
<br />Surface Coal Mining Reclamation Act 34-33-101,
<br />et seq., notice is hereby given of the filing of an
<br />application for Phase I Bond Release on a portion
<br />of the New Horizon Mine site- The application
<br />pertains to the New Horizon Mine, Permit No.
<br />0-1981-008 (approved on 5/26/1963) by Western
<br />Fuels — Colorado A Limited Liability Company,
<br />P. o. Box 628, Nucla, Colorado 81424, filed with
<br />the Colorado Division of Reclamation, Mining and
<br />Safety (CDRMS), Colorado Depa t ment of Natural
<br />Resources, 1313 Sherman Street, Room 215,
<br />Deaver, Colorado 80203. The New Horizon Mine
<br />is located approximately 2 miles west of Nucla,
<br />Colorado.
<br />The Section 6 bond release areas were reclaimed in
<br />2015 and encompasses 13.6 acres. The Section 31
<br />bond release area was reclaimed between 2004 and
<br />2010 and encompasses 9.9 acres. The status of
<br />the reclamation is consistent with the requirements
<br />of the approved reclamation plan which included
<br />removing the overburden storage pile, regrading
<br />to the approved post mine topography, end top-
<br />scif replacement. Listed below is a general legal
<br />description of these areas:
<br />In the NYz t£ SE14 of Section 6, Township 46 North,
<br />Range 15 West and SW% of Section 31 Township
<br />47 North, Range 15 West of the 6th P.M., County of
<br />Montrose, State of Colorado.
<br />New Horizon Mine currently holds a seN-bond for
<br />$5,300,000, which covers the above listed areas.
<br />With this application, New Horizon Mine will be
<br />requesting relinquishment of 60% of the bond
<br />held for the Phase I parcels applied for under this
<br />application.
<br />A copy of the bond release application is on
<br />file at the Montrose County Clerk and Recorder's
<br />Office located in the Montrose County Associate
<br />Courthouse, 300 Main Street, Nucla, Colorado
<br />81424.
<br />Written comments, objections, and requests for a
<br />public hearing or informal conference concerning
<br />this bond refease application should be addressed
<br />to the Colorado Division of Reclamation Mining and
<br />Safety, Colorado Department of Natural Resources,
<br />1313 Sherman Street, Room 215, Denver, Colorado
<br />80203.
<br />Comments must be filed within thirty (30) days from
<br />the last date of this publication, or within lhirty (30)
<br />days of the completed inspection by the CORMS
