BOX 33695 DENVER, COLORADO 80233-0695 303-452-6111 <br />March 16, 2016 <br />Mr. Brock Bowles <br />Environmental Protection Specialist <br />Colorado Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RE: New Horizon Mine <br />Permit No. C-1981-008 <br />MR -97 Adequacy Review Response <br />Dear Mr. Bowles: <br />Tri-State Generation and Transmission Association (Tri-State) has received your adequacy review <br />letter for MR -97, dated March 15, 2016 and provides the following responses to your comments on <br />behalf of the Western Fuels -Colorado, A Limited Liability Company (Western Fuels -Colorado) <br />New Horizon Mine. <br />4.05.13(l) — Groundwater Monitoring <br />A written interpretation of monitoring data, identifying trends and including descriptions of <br />groundwater level and annual potentiometric surface maps was request to be included in the <br />annual hydrology reports. The operator provided a response that a written interpretation of <br />the data will be provided in the annual hydrology report, but there is no reference to when <br />this will occur. The recently submitted 2015 annual hydrology report did not include an <br />interpretation of the data provided. Please define that this additional interpretation of data <br />will occur from 2016 forward. <br />Response: The Division needs to note that the 2015 Annual Hydrology Report (AHR) was <br />submitted in nearly the same time frame that the midterm review was issued by the Division. <br />The Division required the midterm review to be addressed by February 26, 2016. MR -97 <br />was submitted to address the midterm adequacy on February 22, 2016. The AHR is due at <br />the end of calendar year. Thus MR -97 was not approved prior to submittal of the 2015AHR, <br />and the commitment to provide the data was not approved prior to submittal of the 2015 <br />AHR.
