RECEIVED <br /> .. <br /> READY-MIX rR ✓ MAR 0 7 2016 <br /> CONCRETE DIVISION OF RECLAMATION <br /> MINING AND SAFETY <br /> March 2,2016 <br /> PO BOX 299 <br /> LOVELAND, CO 80539 <br /> Mr. Peter Hays <br /> OFFICE 970.667.2680 Colorado Division of Reclamation, Mining and Safety <br /> FAX 970.667.0092 Department of Natural Resources <br /> 1313 Sherman Street, Room 215 <br /> Denver,CO 80203 <br /> RE: Partial Release:Green/Croissant Sand and Gravel Mine <br /> Permit No. M2001-022 a <br /> Dear Mr. Hays, <br /> I am submitting additional documentation to help clarify earlier information <br /> submitted as part of this request for partial release. <br /> Documentation from the Army Corps of Engineers,dated August 27,2008,approving <br /> and releasing the mitigated wetlands were included in the original release request. <br /> As can be seen on page 8 of the Mitigation Wetland Annual Report, dated September <br /> 25, 2007,the total size of the mitigation wet meadow was determined to be 4.16 <br /> acres, in excess of the 3.05 acres required by the permit; and the total area of the <br /> mitigation oxbows was calculated to be 3.92 acres,in excess of the 3.55 acres <br /> required by the permit. <br /> This report also references the hydrology source for the wetlands that comes from <br /> near surface groundwater from farm fields and the pond(adjacent to wetlands <br /> meadow). All of the exposed water surfaces for this Permit have been augmented in <br /> Water Court Case CW2009CW105. A copy of 2009CW105 was also included with the <br /> original release request; as per this decree Loveland Ready Mix Concrete, Inc. is <br /> responsible for replacing evaporative depletions for all exposed surface areas <br /> including all ponds, located on the Green and Croissant Pits Site. <br /> Enclosed with this letter is a copy of the receipt submitted by August Services Inc.on <br /> October 30, 2015,for treatment of Mullien on the south end of the Green and <br /> Croissant properties. August Services Inc. is scheduled to treat the Mullien again this <br /> spring. <br /> Also enclosed with this letter are revised drawings Exhibits C-3 and F-1 that reflect <br /> the correct boundary line revision and include clarification of the location of the <br /> boundary, particularly the new boundary line south of the batch plant. <br />
