Albert Frei and Sons, Inc. - Priola Pit <br />M.L.R.B. Permit # M-2007-087 <br />Technical Revision for a Reclamation start extension <br />This is a formal request to obtain an extension for commencing <br />and completing reclamation at the Priola Pit. The division has <br />determined that mining ended on or around April 20, 2011 and <br />reclamation should be completed by April 20, 2016. <br />In the approved Reclamation Plan we stated that it may take 5 <br />years or more years after mining ended to complete filling the <br />mined area so reclamation could begin. We were on time to <br />complete filling within this time schedule until the land owner <br />CAP Land, Inc. (CAP) requested slope changes and additional <br />filling, over what was required in the approved permit. CAP then <br />disputed our activities and forbid us from continuing operations <br />and filed a complaint with the Division of Reclamation, Mining & <br />Safety. After the mine was inspected by the Division on <br />12/19/2014, CAP refused us entry to the mine to complete <br />reclamation. The result of the dispute has escalated into a <br />civil law suit that was filed on or around July 14, 2015, a copy <br />was provided to the Division on October 9, 2015. <br />If we had been able to complete grading and shaping the site <br />would have been seeded in 2015 year and the 5 year reclamation <br />phase as outlined in Rule 3.1.3 would have started. Due to the <br />civil actions Albert Frei & Sons, Inc. is unsure of when we will <br />be able to complete reclamation and find it necessary to ask for <br />3 additional years to complete grading and shaping. We hope that <br />by April 20, 2019 the outstanding issues will be resolved and <br />final grading, shaping and seeding can be completed. <br />
