DRMS Permit No. C-2009-087 MR28, Adequacy Review No. 1 Dear Mr. Nettleton: The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed the above referenced revision. The following items will need to be addressed prior to the Division's approval of the revision. 2.03.4 — Identification of Interests 1. Please update page 2.03-10, section 2.03.4(2) to include the telephone number of the applicant/operator. 2. The revised pages are missing the information required by Rule 2.03.4(3)(a) for Bowie Colorado Operations. This information does not appear to be previously noted as indicated on proposed revised page 2.03-11. 3. Please update page 2.03-11, section 2.03.4(3) to provide the employer identification number for all of the Bowie entities (Bowie Colorado Operations, LLC., Bowie Western Resources, LLC., Western Megawatt Resources, LLC., Bowie Resource Holdings, LLC., and Bowie Resource Partners, LLC.) 4. Upon closing of the sale, please update the officer list for Bowie Colorado Operations, LLC. and Bowie Western Resources, LLC., with the beginning dates for the officers and directors. These pages will need to be revised prior to the approval of the revision. 5. A table labeled, "Bowie Pending SMCRA Permit Applications" was submitted. Please update this table to indicate the regulatory authority for the pending applications. 2.03.5 — Compliance Information: 6. The applicant proposes to revise Exhibit 2.03.5-E1 with Table 1-2 that lists the three year violation history of mining and reclamation operations. For each violation listed, please provide the MSHA number for the operation in which the violation was issued and the name of the authority that issued the violation in accordance with Rule 2.03.5(3)(a). 7. Please revise Table 1-2 of Exhibit 2.03.5-E1 to list the date, location and type of any administrative or judicial proceedings initiated concerning the violations listed, including, but not limited to, proceedings initiated by the applicant to obtain administrative or judicial review of the violations in accordance with Rule 2.03.5(3)(c).
