The Division, therefore, determined that the EPF certification of the tailings <br />impoundment is void and the liner can no longer be used for its intended purpose. <br />9. On October 8, 2015, the Division mailed Operator a copy of the report <br />from the September 2015 Inspection. On the inspection report, the Division cited a <br />problem for the improperly placed mine dump materials and required Operator to <br />provide a Technical Revision addressing re -certification of the tailings <br />impoundment liner within thirty (30) days, by November 7, 2015. <br />10. On October 29, 2015, Operator mailed the Division a request to extend <br />the 30 -day deadline for submitting a Technical Revision by 235 days, to June 30, 2016. <br />11. On November 4, 2015, the Division notified the Operator in writing <br />that the deadline for submitting a Technical Revision was extended by twenty-two <br />(22) days, to November 30, 2015. <br />12. On November 19, 2015, the Division inspected the site as a follow-up to <br />the September 2015 Inspection ("November 2015 Inspection") and to discuss with <br />Operator options for recertifying the tailings impoundment liner. Patrick Maher <br />and Ron Reeser attended the inspection on behalf of Operator. During the <br />November 2015 Inspection, the Division observed two groundwater monitoring <br />wells located both above -gradient and down -gradient from the site. The monitoring <br />wells consist of two-inch (2") diameter HDPE pipes that extend down approximately <br />twenty feet (20') to bedrock and extend approximately six feet (6') above the ground <br />surface. The Division observed that the above -ground portion of both monitoring <br />wells was bent at an approximate forty-five degree (45°) angle. The September <br />2015 Inspection report noted the Division's concern that the configuration of the <br />HDPE pipes "make them susceptible to damage" and stated "it is unlikely the <br />Operator would be able to obtain a groundwater sample from the wells at the <br />existing angle." During the inspection, Operator described the processes to <br />determine if there is water in the well and for collecting a groundwater sample. <br />The Division found that the process described by Operator did not conform to the <br />approved groundwater sampling plan. <br />13. In the report from the November 2015 Inspection, the Division cited a <br />possible violation for the improperly placed mine dump materials as a failure to <br />comply with the mine plan and reclamation plan and noted a problem with the <br />groundwater monitoring. <br />14. On December 11, 2015, the Division mailed Operator a copy of the <br />report from the November 2015 Inspection. <br />15. On December 14, 2015, the Division sent a Reason to Believe a Violation <br />Exists and Notice of Board Hearing letter to the Operator.
