March 3, 2016 <br />Mr. Brock Bowles <br />Environmental Protection Specialist <br />Colorado Division of Reclamation Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Suite 215 <br />Denver, CO 80203 Sent via email, to: brock.bowles@state.co.us <br />RE: Comment on New Horizon Mine (Permit No. C-1981-008), Technical Revision No. 71 (TR -71) <br />Published March 3, 2016. <br />Dear Mr. Bowles, <br />We are in receipt of Western Fuels — Colorado, LLC's (WFC) March 3, 2016 publication for a Technical Revision (TR - <br />71) to construct a post mine stock pond in the same location as the stock pond that was there during mining and <br />pre mining activities. <br />Today is March 3, 2016, which is within the 10 -day comment period of the Publication Date (3/3/2016), per <br />regulations. <br />We have reviewed WFC SPI Design Specifications on Drawing No. Map 2.05.3(3)-34-1, dated 1/22/2016, and as <br />the land owner upon which the pond is located, we request that the Primary Discharge Pipe design be moved from <br />the current proposed location to the bottom (elevation 5730') and center of the pond, approximately along the <br />southern Profile Locations A to A' line, beginning at 0+00 and ending at 1+20, and installing at the inlet end an Inlet <br />Water Level Control Structure approximately at 1+12 location on the current Profile Locations A to A' mark. <br />The current plan calls for: <br />1. 7 @ 20' sticks of 18" CMP pipe. <br />2. 1 @ 452 elbow. <br />3. 2 @ anti -seep collars. <br />The change would call for: <br />1. 6 @ 20' sticks of 18" CMP pipe. <br />2. 1 @ 18" x 6' Inlet Water Level Control Structure. <br />3. 2 @ anti -seep collars. <br />The change would require one less 20'x18" stick of pipe and one 18" 452 elbow, but requires one 18"x6' Inlet <br />Water Level Control Structure, to allow for the ability to drain the pond and to control the discharge rather than <br />only being able to discharge at high water level.
