has successfully completed all surface coal mining reclamation operations in accordance with this <br />approved reclamation plan, and the final inspection procedures of 3.03.2 have been satisfied. This shall <br />not be before the expiration of the period specified for revegetation responsibility in 3.02.3." Rule <br />3.03.1(4) states, "No bond shall be fully released until all reclamation requirements of these Rules and the <br />Act are fully met...". The same rule goes on to state, "No acreage shall be released from the permit area <br />until all surface coal mining and reclamation operations on that acreage have been completed in <br />accordance with the approved reclamation plan." <br />The vegetation establishment standards associated with the Phase III Bond Release do not apply to the <br />portions of 5th Street and BB Road that are the subject of SL -17. The post -mining land use is Road and <br />there were no requirements for revegetation within the right-of-way. <br />The operator mined through certain segments of Montrose County's 5th Street and BB Road. During <br />mining, traffic was rerouted around the perimeter of the disturbed area to maintain access for local <br />landowners. As the mine operations continued to move westward, the original alignments of 5th Street <br />and West BB Road were reconstructed and surfaced with gravel. <br />Details regarding reconstruction of West 5th Street and West BB Road are provided in the following <br />approved permit sections: <br />Section 2.05.3(3) Mine Facilities (pages 33-35 and 39-40) <br />Attachment 2.05.3(3)-1-3 Collection/Diversion Ditches and Culvert Design Parameters <br />Attachment 2.05.3(3)-8 Road and Structure Agreements and Letter <br />Map 2.05.3(3)-1 Surface Water Hydrology <br />Map 2.05.3(3)-1-2 Post Mine Surface Water Hydrology <br />Map 2.05.3(3)-8 Mine Roads <br />Map 2.05.3(3)-13 Restored County Road Typical Cross Section <br />Letters from Montrose County stating it has resumed its jurisdiction and will be responsible for the <br />maintenance of 5th Road, BB Road (as shown on Map 1) and the 60 -foot of right-of-way for each road <br />are in the SL -17 bond release application. <br />A total of 9.4 acres are being requested for Phase II and III bond release for 5th Street and BB Road. <br />IV. Observations and Findings <br />The reconstruction of the West 5th Street and West BB Road took place in 2010 and 2015. The roads were <br />constructed to the requirements of the approved reclamation plan and the specifications of Montrose <br />County. <br />Montrose County accepted all responsibilities and maintenance of the reconstructed facilities of the 5th <br />Street in a January 10, 2011 letter. <br />Montrose County accepted all responsibilities and maintenance of the reconstructed facilities of the BB <br />
