No written objections or requests for an informal conference regarding the bond release application were <br />received by the Division. <br />No adequacy questions were raised by DRMS during the inspection or during the application review. <br />III. Criteria and Schedule for Bond Release <br />PHASE I <br />Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released when the <br />permittee successfully completes backfilling, regrading, and drainage control in accordance with the <br />approved reclamation plan." <br />The reconstructed section of 5th Street is located just north of the mine office/facilities area and goes west <br />3,100 feet through the property of several private landowners (see Map 1 for location). 5th Street <br />construction was completed in 2010 and was built to the specifications of the permit and Montrose County. <br />5th Street was built through the middle of Pond 007 and acts like a baffle structure within the pond. Pond <br />007 has been permitted as a permanent structure with two culverts, C -113A and B, which allow water to <br />pass under 5th Street and are designed to pass a 25-year/24-hour event. The as -built calculations for Pond <br />007 are in Attachment 2.05.3(3)-2 of the permit. Phase I bond release was previously achieved on 3.6 <br />acres of 5th Street in SL -4 (1995), SL -5 (1997) and SL -6 (1999). <br />The reconstructed section of BB Road is located west of the junction with 2700 Road. It is from station <br />0+00 to 39+00 on Map 1 of the SL -17 application. BB Road construction was complete in 2015 and was <br />built to the specifications of the permit and Montrose County. <br />A total of 5.8 acres are being requested for Phase I release on 5th Street and BB Road. <br />PHASE H <br />Rule 3.03.1(2)(b) states, "Up to eighty-five percent of the applicable bond amount shall be released upon <br />the establishment of vegetation which supports the approved postmining land use and which meets the <br />approved success standard for cover... based on statistically valid data collected during a single year of the <br />liability period". <br />The topsoil replacement and vegetation establishment standards associated with the Phase II Bond Release <br />do not apply to the portions of 5th Street and BB Road that are the subject of SL -17. The post -mining land <br />use is Road and there were no requirements for topsoil replacement or revegetation within the right-of- <br />way. <br />PHASE III <br />Rule 3.03.1(2)(c) states that the final portion of performance bond, "shall be released when the permittee <br />
