$5,432,359.95. Asa result of the work accomplished for SL -16, the reclamation cost estimate was reduced <br />by $436,761.74 for a remaining liability of $4,995,598.21. During this time, TR -69 was finalized which <br />increased the mine's liability by $9,585.90. This amount, however, was not included in the SL -16 cost <br />estimate. The Division's decision to approve SL -16 is being re -proposed to include the increased liability <br />costs associated with TR -69. The explanation of how the new reclamation cost estimate was calculated is <br />stated below. <br />The Division updated the NI -12 reclamation cost estimate (RCE) for Midterm Review 7 (MT -7) on <br />November 24, 2015. This RCE was completed prior to the Division's January 5, 2016 proposed decision <br />to approve the SL -16 bond release. The updated estimate of $5,432,359.95 and the additional cost of TR - <br />69 ($9,585.90) totaled $5,441,945.85, which is $141,945.85 more than the current bond held of <br />$5,300,000. As a result, the SL -16 bond release amount will be subtracted from the amount of <br />$5,441,945.85. <br />The Division estimates its cost to complete remaining reclamation work at the site to be $5,004,413.40 <br />(see attached memo dated February 25, 2016). The Division proposes to release $437,532.45 via SL -16 <br />(see attached memo dated February 25, 2016). Subtracting $437,532.45 from the new updated estimate <br />total of $5,441,945.85 will leave a liability in the amount of $5,004,413.40. Should the $5,300,000 bond <br />be reduced to $5,004,413.40, this amount will be sufficient to assure completion of the remaining <br />reclamation work at the site if the work had to be performed by the Division, including the cost of <br />reestablishing vegetation on any revegetated areas, should those areas fail (Rule 3.03.1(3)(a) and <br />3.01.3(3)(4)). <br />Any person with a valid legal interest which might be adversely affected by this proposed decision may <br />request a formal public hearing before the Mined Land Reclamation Board in accordance with Rule <br />3.03.2(6). Public notice of this proposed decision will be published twice in the San Miguel Basin Forum <br />as soon as possible. Requests for public hearing must be submitted to the Division in writing within thirty <br />days of the first publication in the San Miguel Basin Forum.
