It Procedures and Summary of the Review Process <br />Western Fuels -Colorado, LLC applied for a partial Phase I bond release under the Colorado Surface Coal <br />Mining and Reclamation Act following reclamation of the New Horizon Mine. The mine is located in <br />Montrose County, 1.7 miles northwest of the Town of Nucla. The mine area is located in the USGS 7.5 <br />minute Nucla Quadrangle map. <br />All or portions of the following: <br />Sec 6 T46N, R15W: W 1/2 NE 1/a; W 1/2 SW 1/4 NE 1/a; NW 1/a; <br />N 1/2 NE 1/4 SW 1/4; N 1/2 SE 1/4; N 1/2 SE 1/4 SE 1/4 <br />Sec 31 T47N, R15W: SW 1/4 <br />Seel T46N, R16W: N 1/2NE 1/4NE 1/4; NW 1/4NE 1/4; NW 1/4SE 1/4NE 1/4; <br />NE 1/4 NW 1/4; N 1/2 SE 1/4 NW 1/4 <br />Sec 36 T47N, R16W: SW 1/4; SE 1/4 <br />Sec 25 T47N, R16W: SW 1/4 <br />The total permit acreage for the New Horizon Mine area is 928.89 acres. The SL -16 application <br />requests a Phase I bond release for the backfill and grading of 107.8 acres in Section 1 of T46N R16W. <br />Maps prepared by WFC for this bond release area are located in the SL -16 application. <br />Summary of Bond Releases for the New Horizon Mine <br />SL -01 granted release of 55.6 acres from the northeast corner of the Mine 1 permit area. The property <br />was to be used Montrose County, the landowner, to expand the adjacent landfill. Release was approved <br />on July 5, 1989. <br />SL -02 granted release of an additional 14.02 acres from Mine 1 for expansion of the Montrose County <br />landfill. Release was approved on October 6, 1993. <br />SL -03 approved Phase I bond release for 215.5 acres at the New Horizon Mine 1. The release was granted <br />on December 16, 1994. The application also requested Phase 11 release for portions of Mine 1, but the <br />request was denied due to insufficient revegetation. <br />SL -04 granted Phase I bond release for the remaining 98.6 acres of Mine 1 (the "Rice tract"). Phase I <br />release was also granted for 51.8 acres in the southeastern corner of New Horizon Mine 2. The release <br />was approved on May 6, 1996. <br />SL -05 granted Phase I bond release for an additional 67.4 acres at Mine 2. The release was approved on <br />January 8, 1998. <br />SL -06 granted Phase I bond release for an additional 43.4 acres at Mine 2. This release was approved on <br />July 23, 1999. <br />SL -07 approved additional bond releases at New Horizon Mine 1. Included were Phase 11 release for <br />4 <br />
