52.05 APPLICATION FOR PERMIT FOR SIIRFACE OR UNDERGROUND MINING ACTIVITIES --
MINIMUM REQUIREMENTS FOR OPERATION AND RECLAMATION PLANS.
2.05.6 Mitigation of Surface Coal Mining Operation Impacts. (Cont'd.)
(3) (b) (iv) (Cont'd.)
L

adjudicated and historically used water right
will be deemed significant. Further, Colorado
Division of Wildlife, Bureau of Land Manage-
ment, and U. S. Forest Service range and wild-
life specialists concur that a one-mile radius
from a water resource is adequate for the ex-
isting livestock and big game populations.
Refer to [he CDOW, BLM, and USFS correspon-
dence in the Surface Water Appendix, Volume
4.
The location of fences can alter or disrupt
Livestock or wildlife migrations. Through an
inventory of fence lines, historical grazing,
wildlife use, and a water mitigation plan, CWI
proposes to designate one significant pond or
spring with one alternate pond or spring with-
in a one-mile radius from the pond or within
discrete fenced areas (see the Significant
Ponds and Significant Springs Table in the IJa-
ter Replacement Plan Appendix, Volume 5A). In
areas covered by the Subsidence Control Plan
of limited extraction, no alternate pond or
spring is necessary. In the possible instance
of significant disruption, the alternate pond
or spring would provide water for stock and
wildlife use while the significant feature was
being repaired and refilled (refer to Subsi-
dence Repair Handbook, Voltrtne 3). In this
fashion, any deleterious effect upon land use
by mine subsidence would be mitigated, and ma-
terial damage would not occur.
Also, specific water replacement plans have
been developed for significant ponds and sig-
nificant springs (refer [o Water Replacement
Plans, Volume SA).
The duration of this impact is considered
short term, in the range of several years.
The impacts of subsidence are transitory in
time and space; that is to say tension
Added 12/26/84
Added 03/07/85
Revised 10/01/87
130
