Any discharge to the waters of the State from a point source other than specifically authorized by this permit is prohibited. B. PERMIT COMPLIANCE In accordance with the Colorado Discharge Permit System Regulations, Section 61.8(2), 5 C.C.R. 1002-61, and the federal Effluent Limitation Guideline for the Coal Mining Point Source (40 CFR 434), the permitted discharge shall not contain effluent parameter concentrations which exceed the limitations specified below. All discharges authorized under this permit shall comply with all the terms and conditions required by this permit. Violation of the terms and conditions specified in this permit may be subject to civil and criminal liability pursuant to sections 25-8-601 through 612, C.R.S.. Failure to take any required corrective actions, as detailed in the CORRECTIVE ACTIONS section, constitutes an independent, additional violation of this permit and may be subject to civil and criminal liability. C. EFFLUENT LIMITATIONS 1. Narrative Water Quality Based Effluent Limitation Discharges authorized under this permit must be controlled as necessary to meet applicable water quality standards. The division expects that compliance with the other terms and conditions in this permit will control discharges as necessary to meet applicable water quality standards. If at any time the permittee becomes aware, or the division determines, that the authorized discharge causes or contributes to an exceedance of applicable water quality standards, the permittee must take corrective action as required, document the corrective actions as required, and report the corrective actions to the Division as required (see CORRECTIVE ACTIONS). If the division becomes aware of information indicating that compliance with the other terms and conditions of this permit will not control the discharge as necessary to meet applicable water quality standards, the division may include additional site-specific water quality -based effluent limitation(s) to the discharge.
