(Tri-State) is submitting the enclosed <br />"Application Form for a Revision to a Coal Mining and Reclamation Permit" for a minor revision application <br />on behalf of the Western Fuels -Colorado, A Limited Liability Company (WFC) New Horizon Mine. Tri- <br />State is the parent company of WFC. The New Horizon Mine operates under the Division of Reclamation, <br />Mining and Safety (DBMS) Permit No. C-1981-008. <br />Minor Revision No. 97 (MR -97) is being submitted to address the midterm review adequacy <br />questions and incorporate the responses into the PAP where applicable. Tri-State has received your midterm <br />findings document, dated November 24, 2015 and provides the following responses to your adequacy <br />questions on behalf of the WFC New Horizon Mine. <br />2.03. 10 — Identification of Licenses and Other Permits <br />1. Please update expiration dates for all the permits in this section. <br />Response. Section 2.03. 10 of the PAP is currently being updated in the MR -96 application. <br />Therefore, the information required by Rule 2.03. 10 regarding Identification of Other Licenses and <br />Permits including, type of permit or license; name and address of issuing authority; identification <br />number of the permit or license; and date of approval will be updated in MR -96. <br />2.04.11 —Baseline Fish and Wildlife Information <br />1. Page 2.04.11-4 references the original Peabody Permit application: Volume D — Tab 11 for the <br />original wildlife study conducted for the permit area. Please update this page to indicate that this <br />information is included in Attachment 2.04.11-1 of the permit. Also, please update the table of <br />contents of this section of the permit to cite this attachment. <br />Response: Page 2.04.11-4 has been updated to indicate that the Wildlife Baseline Report — Nucla <br />Mine from Peabody Tab 11 is included in Attachment 2.04.11-1 of the PAP.
