Summary <br />The Review Process <br />Twentymile Coal (TC), a subsidiary of Peabody Investments Corporation, submitted a permit <br />revision application (PR -11) for the Foidel Creek Mine. The Foidel Creek Mine is exclusively <br />an underground coal mining operation located approximately 22 miles southwest of Steamboat <br />Springs, Colorado in Routt County. Permit No. C-1982-056 was issued on May 23, 1983, and <br />has been renewed every five years since that date. <br />TC submitted the PR -11 application on July 8, 2015. Following TC's submittal of additional <br />information, the application was found complete on August 25th, 2015. TC published a notice of <br />the application in the Steamboat Pilot & Today, four consecutive weeks from September 6, 2015 <br />through September 27, 2015. <br />No objections regarding the application were received. The Division received one comment <br />letter. History Colorado submitted a comment letter dated September 11th, 2015. Based on the <br />cultural resources survey conducted regarding the PR -11 application, two sites (5RT3324 and <br />5RT3325) were considered to be eligible for listing in the National Register of Historic Places <br />(NRHP). The letter further requested that an analysis be conducted to determine the effects <br />subsidence would have on these sites. TC conducted the required analysis and the results were <br />submitted to History Colorado for review. On December 1St, 2015 the Division received a letter <br />from History Colorado indicating they concurred that these sites would not be adversely affected <br />by subsidence. <br />The applicant violator system (AVS) was queried on September 9th, 2015 and the <br />recommendation of the system was to provide ownership and control updates. TC revised <br />Exhibit 47 of the permit with the necessary updates. A follow-up AVS query was conducted on <br />February 24, 2016 and the results indicated that no violations were found and the updated <br />ownership and control information is adequate. <br />On September 28, 2015 the Division sent TC a preliminary adequacy review letter. The letter <br />identified several textual and formatting issues that would need to be addressed. Several <br />adequacy items were identified regarding the subsidence monitoring plan. Several items were <br />identified regarding mining impacts to alluvial valley floors and the water monitoring plan. <br />Finally, the Division requested that TC conduct an analysis on the possible effects of subsidence <br />on two cultural resources sites (5RT3324 and 5RT3325) that were identified during the cultural <br />resource survey conducted for PR -11. On October 8, 2015 the Division sent TC a letter <br />requesting several updates to the ownership and control information contained in Exhibit 47 of <br />the permit. On November 4th, 2015 the Division received a letter from Metcalf Archaeological <br />Consultants, Inc. (Metcalf) at the request of TC. This letter included Metcalf s analysis of <br />subsidence related impacts on the two cultural resources sites discussed above. This information <br />was forwarded to History Colorado for review. On December 1St, 2015 the Division received a <br />letter from History Colorado that concurred that subsidence would likely not adversely affect the <br />two sites. On November 27, 2015 the Division received a response from TC regarding the <br />adequacy review issues identified in the Division's preliminary adequacy review letter and the <br />letter regarding their ownership and control information.
