This decision will be published in the Canon City Daily Record as soon
as possible. Publication of the notice initiates a thirty (30) day public comment period. If,
within thirty days, there are no requests for an adjudicatory hearing, the decision will become
final.
EFCI asked for Phase II and III release of 102 acres; 0.3 acre of this area was removed because
of the Magpie seep, which is still under discussion. EFCI asked for release of $351,376; based
on the cost estimate for remaining tasks, the Division proposes release of $340,922. There was
an additional 9.6 acres of permanent features that were not accounted for in the EFCI acreage
numbers in the SL -03 application. This has been included in the Phase I disturbed acres.
As an interested party, you have the right to an adjudicatory hearing as outlined under Rule
3.03.2(6) of the Rules and Regulations.
