This decision will become
final at the close of the thirty (30) day public comment period, which commences with the initial
publication in the Cañon City Daily Record. A copy of the proposed decision and written
findings is enclosed.

EFCI asked for Phase II and III release of 102 acres; 0.3 acre of this area was removed because
of the Magpie seep, which is still under discussion. EFCI asked for release of $351,376; based
on the cost estimate for remaining tasks, the Division proposes release of $340,922. There was
an additional 9.6 acres of permanent features that were not accounted for in the EFCI acreage
numbers in the SL-03 application. This has been included in the Phase I disturbed acres.

As provided by Rule 3.03.2(6), should you object to the Division's proposed decision, you may
request an adjudicatory hearing.

If you have questions or need of additional information, please contact me.
