A total of 93.96 acres will remain within the permit boundary. The Green/Croissant Pit is <br /> included in the Loveland Ready Mix Concrete, Inc. plan for augmentation decreed in Division 1 Water Court <br /> case no. 2009CW105. <br /> According to the Applicant, the subject 115.38 acres to be released are land that has not been mined or has <br /> already been reclaimed in accordance with their permit requirements for wetlands mitigation. A total of 6.54 <br /> acres of jurisdictional and non-jurisdictional wetlands were anticipated to be impacted by mining operations. <br /> The Applicant proposed to mitigate the disturbance by creating 7.05 acres of new wetlands. The new wetlands <br /> were proposed to be created prior to the disturbance of the existing wetlands in order to ensure <br /> establishment.
