Will need augmentation plan
West ponds filed in court at least three years prior to the
completion of mining.
Conditions of Approval
I hereby approve this substitute water supply plan, in accordance with Section 37-90-137(11),
C.R.S., subject to the following conditions:
1. This SWSP shall be valid for the period of November 13, 2015 through October 31, 2016,
unless otherwise revoked, modified, or superceded by decree. If this plan will not be
made absolute by a water court action by the plan's expiration date, a renewal request
must be submitted to this office with the statutory fee (currently $257 per site) by
September 15, 2016.
2. The total area of pond surface exposed at the Riverbend West and Riverbend East after
December 31, 1980 for each of the unlined pits shall not exceed those values listed in Table A
of this approval. Should the total surface area exposed exceed those amounts, an
amendment will need to be filed with this office. The applicant does not anticipate any
ground water exposure beyond the old M-1985-088 permit boundary and thus a new permit is
not required to be obtained for this SWSP to be valid.
4.
