This value includes depletions from past activity that hit the river during <br /> this timeframe. <br /> Replacements <br /> The replacement sources for this SWSP include the following: <br /> • Consumptive use portion of RMCC's 5 Fulton Ditch shares. <br /> • Consumptive use credits from the Fulton Ditch shares previously stored in City of Brighton <br /> storage (Kenneth Mitchell Lake, Erger's Pond or 124`h Storage Pond). <br /> • Water lease with the City of Brighton for up to 250 acre-feet per year. <br /> The previous SWSP approval required that any future SWSP requests provide additional <br /> information about the use of the Fulton Ditch shares on the Arends and Tower Farms, including years <br /> of use and non-use and a historical consumptive use analysis ("HCU"). RMCC now only included 5 <br /> Fulton Ditch shares associated with Arends Farm. The 11 Fulton Ditch shares previously included in <br /> the SWSP associated with the Tower Farm were removed from the plan. However this SWSP will <br /> make replacement of the remaining return flows obligations (January through March) from the use of <br /> the 11 Fulton Ditch shares associated with the Tower Farm in the previous SWSP (see Table 1 C, <br /> column 22). <br /> As requested, a revised HCU analysis was provided with the SWSP request. In the previous <br /> SWSP the HCU analysis for the 5 Fulton Ditch shares was strictly based on the analysis performed in <br /> the support of the decree in case no. 2009CW279. For this SWSP request the HCU analysis for the 5 <br /> Fulton Ditch shares used on Arends Farm was extracted and modified from the HCU analysis <br /> presented in the June 2010 engineering report ("Report") for case no. 2009CW279. Based on the <br /> detailed reviewed of the HCU analysis in case no. 2009CW279 you have concluded that the <br /> methodology used is adequate to support the site-specific analysis required for this SWSP, with the <br /> following modifications. <br /> RMCC's 5 Fulton Ditch shares were historically used on the Arends Farm along with 25 other <br /> Fulton Ditch shares. The 25 shares were changed by Castle Pines North in case no. 2009CW279. The <br /> decreed in case no. 2009CW279 actually changed the use of 105 Fulton Ditch shares. The five shares <br /> used on the Arends Farm were part of the original HCU analysis performed for case no. 2009CW279, <br /> from 1950 through 1985, but were not changed. In 1986 the 5 shares were sold to Henderson <br /> Aggregate. You indicated that you do not have any information at this time regarding the use of the <br /> five shares from 1986 to 2005. After 2005 RMCC started using the five shares in SWSPs. A copy of the <br /> Report in case no. 2009CW279, dated June 2010 prepared by Applegate Group ("Applegate") was <br /> submitted to this office with the 2010 SWSP request.
