E. Cessation Order C-85-069 issued on July 22, 1985 was for "Failure to <br /> contemporaneously reclaim". This CO related to the entire site. <br /> Abatement for this enforcement action is to "Reclaim site in accordance <br /> with Rules and Regulations". <br /> La Plata proposes to remove all accumulated trash or debris and remove <br /> any unnecessary structures. La Plata proposes to retain the "crushing <br /> and loadout facility area", the "conveyor", and the portals due to <br /> anticipated future coal mining plans. Since these actions are in <br /> accordance with the required abatement, these actions are deemed <br /> appropriate by the Division. <br /> F. La Plata proposes fixing and surfacing the deteriorating access road to <br /> allow for access to the upper bench for purpose of reclamation and <br /> clean up. Included in this fixing will be the installation of drainage <br /> ditches along the side of the road to reduce previous erosion <br /> problems. As long as the requirements for "Access Roads" as described <br /> pursuant to Rule 4.03.2 of the Regulations of the Colorado Mined Land <br /> Reclamation Board for Coal Mining are complied with, the Division deems <br /> this action appropriate. <br /> III. This Letter of Understanding is hereby accepted as evidenced by the <br /> signatures for the Division and for La Plata. <br /> A.
