Mr. David Bird <br />Colorado Division of Mining, Reclamation and Safety <br />August 25, 2010 <br />Page 2 <br />We do not feel that Lafarge is serious about leaving exposed water surfaces (in <br />violation of our lease and your permit) since they have failed to file for approval of an <br />augmentation plan in Water Division No. 1 in accordance with your rules and <br />regulations. They of course have filed annual substitute supply plans with the State <br />Engineer's Office, but have not made the required filing in Water Court if they were <br />serious in this regard. <br />The current mining lease expires September 10, 2010 and I would suggest that <br />you might schedule a compliance inspection shortly thereafter.
