Mr. David Bird
Colorado Division of Mining, Reclamation and Safety
August 25, 2010
Page 2
We do not feel that Lafarge is serious about leaving exposed water surfaces (in
violation of our lease and your permit) since they have failed to file for approval of an
augmentation plan in Water Division No. 1 in accordance with your rules and
regulations. They of course have filed annual substitute supply plans with the State
Engineer's Office, but have not made the required filing in Water Court if they were
serious in this regard.
The current mining lease expires September 10, 2010 and I would suggest that
you might schedule a compliance inspection shortly thereafter. We know that the fill
activity has not been completed and have indicated that we won't object to Lafarge
completing its reclamation activities (including required fill activity) after the lease has
expired.
Thank you for the opportunity to comment on this proposal.
Very truly yours,
IG,--, Gsz----
Ryan Carlson
Landowner Representative
cc: File
Timothy J. Flanagan, Esq.
Steve O'Brian, Environment, Inc.
