To prepare for final release from the permit, Lafarge will need to have the <br />Fifty shares of Fulton Ditch water dedicated to Lafarge to proceed to Water Court for <br />final augmentation per Section 7 of our Amended and Restated Agreement. <br />Finally, our lease expires on September 9, 2010. Lafarge has no desire to extend the <br />lease, and will not do so. We have reclaimed the property by sloping the sides, grading, <br />weeding and seeding activities this past Spring and Summer. Lafarge will need to have <br />access to the site as final release from the site may take a minimum of two years.
