Thanks for going to the effort of providing a digital copy to review. I <br />must say that I was surprised at size of the file. <br />Be that as it may, I have reviewed Allen's memo and don't see any real problems <br />regarding his recommended setback of 100 feet from Xcel's buried gas line along the east <br />side of Brighton Road. Presently, the mining setback from the gas line is approximately <br />110 feet. Regardless, I hope to have a signed agreement from Xcel before the end of the <br />month if not sooner. <br />Regarding the proposed mining setback from the McCanne Ditch (Ditch), Ready <br />Mixed Concrete Company (RMCC) is prepared to apply the 3:1 setback ratio, which <br />Allen Sorenson previously said was acceptable to the Division. Prior to relocation of the <br />Ditch, RMCC commits to a minimum mining setback of 81 feet, which is based on a pit <br />depth of 27 feet (27 x 3 = 81). This setback distance does not apply however to areas <br />adjacent to the Ditch which were previously mined under the original permit.
