--)753-ts \\-\6'
Ideally, for the purpose of calculating the financial warranty the Applicant's preferred
option is number 3. The Applicant's representative has discussed this option with Ms.
Joanna Williams at the SEO and is exploring the feasibility of obtaining a letter of the
type described under option number 3. Unfortunately, it is unlikely that such a letter
can be obtained prior to the Division's October 2009 decision date for Bromley Lakes
Amendment 002.
Therefore, for the purpose of calculating the financial warranty in a ti anner,
and only that purpose, the Applicant requests that the Division useoption 2 address
possible depletions associated with Phase 18.
Regarding Cell 2, the Applicant does not intend to leave any exposed ground water
once reclamation is completed (see Applicant's response to item 19 above). The
following picture shows wetlands created in a wash fines settling pond that does not
contain any exposed ground water. The photograph is of the Marshall Pit wetlands
mitigation bank located adjacent to South Boulder Creek.
21. " It is the Division's interpretation of the mining plan that a maximum of 40 acres will be
disturbed at a time for the remainder of the mining phases and reclamation will be
concurrent with mining. Of these 40 acres, there will most likely be various levels of
disturbance. Please describe the varying levels of disturbance in terms of acreages and
the steps that would be necessary to reclaim the disturbance. For example, at the point
of maximum disturbance, how many acres of land will need to be completely backfilled?
How many acres will need to be partially backfilled? How many acres will need to be
topsoiled and seeded?"
10/2/2009 9
