HART ENVIRONMENTAL <br />EiVVIKO1Nl\iC1V 1tAL <br />PO Box 1303 BouidL1", Colorado 80306 Phone 303 -111 6602 <br />August 13, 2009 <br />Ms. Kathryn Bauer <br />Xcel Energy <br />Siting and Land Rights <br />550 15th Street, Suite 700 <br />Denver, Colorado 80202-4256 <br />Re: Ready Mixed Concrete Company -Bromley Lakes Mining Impact Agreement <br />Dear Kathryn: <br />My client, Ready Mixed Concrete Company (RMCC), has applied to the Colorado <br />Division of Reclamation, Mining and Safety to amend their existing reclamation permit <br />(No. M-1987-049) to mine sand and gravel and reclaim a parcel of land located along the <br />west side of Brighton Road in parts of the South '/2 of the Southwest Vi of Section 13 and <br />the Northwest %4 of the Northwest '/a of Section 24 all in Township 1 South, Range 67 <br />West of the 6th Principal Meridian (PM) in Adams County, Colorado (see enclosed map). <br />The proposed sand and gravel mining operation will occur within 100 feet of Xcel's <br />buried gas line(s) along Brighton Road. RMCC will take every precaution to insure that <br />Xcel's gas line(s) are not damaged as a result of mining and reclamation activities. <br />Enclosed with this letter is an Agreement by which RMCC agrees to repair or <br />replace at its expense any damage to Xcel's property due to the proposed sand and gravel <br />mining operation. If the language of the enclosed Agreement is acceptable to you please <br />return a signed copy to me at P.O.
