AGREEMENT <br />This agreement is made by an between Ready Mixed Concrete Company a Colorado <br />Corporation, 4395 Washington Street, Colorado 80216 and United Power, Inc. a <br />Colorado Corporation, Post Office Box 929 Brighton, Colorado 80601. <br />United Power, Inc. owns overhead power line(s) (structure) located along Brighton Road <br />in parts of the South 1/2 of the Southwest 1/4 of Section 13 and the Northwest 1/4 of the <br />Northwest 1/4 of Section 24 all in Township 1 South, Range 67 West of the 6th Principal <br />Meridian (PM) in Adams County, Colorado, land from which Ready Mixed Concrete <br />Company intends to excavate sand and gravel. Ready Mixed Concrete Company has <br />applied to the Colorado Division of Reclamation, Mining and Safety for an Amendment <br />to its existing Bromley Lakes sand and gravel operation (Permit No. M-1987-049) to <br />mine and reclaim the subject property located west of and adjacent to Brighton Road. The <br />Construction Material Rules and Regulations of the Colorado Mined Land Reclamation <br />Board require the Applicant (Ready Mixed Concrete Company) to provide a notarized <br />agreement between the applicant and the person(s) having an interest in any permanent <br />man-made structures located within two hundred (200) feet of the affected land, <br />acknowledging that the Applicant agrees to provide compensation for any damage to said <br />structures. <br />Therefore, Ready Mixed Concrete Company agrees to repair or replace at its expense any <br />damage to the above referenced structure(s) due to its sand and gravel mining operation <br />as approved by the Colorado Mined Land Reclamation Board. <br />In witness whereof, the parties sign and accept this agreement on the day of August <br />2009. <br />READY MIXED CONCRETE COMPANY <br />By: <br />Title: <br />State of Colorado <br />County of Denver <br />The foregoing instrument was acknowledged before me this day of August 2009 by <br />as of Ready Mixed Concrete Company <br />Notary Public <br />1 <br />
