Applicant's Response: <br />All structures located within the boundaries of the affected land are owned by the <br />Applicant and will be removed prior to mining. All structures located within 200 feet <br />of the affected land have been previously identified on Exhibit C. <br />A list of "Permanent Man -Made Structures" within 200 feet of the mining limits and <br />the owners of these structures is included with this Adequacy Review Response <br />document as attachment number 12. <br />Pursuant to Rule 6.4.19 the Applicant has sent letters to the owners of "Permanent <br />Man -Made Structures" within 200 feet of the mining limits offering to enter into an <br />agreement with the owner agreeing to provide compensation for any damage to the <br />structure as a result of the applicants mining and reclamation activities. A copy of the <br />transmittal letter and proposed agreement with United Power can be found in the <br />attachment section of the Adequacy Review Response (see attachment number 8) and <br />is typical of what the Applicant has sent to the owners of other "Permanent Man -Made <br />Structures" within 200 feet of the amended mining limits. <br />6.4.4 EXHIBIT 11 -MINING PLAN <br />5. "With this amendment, Ready Mixed Pit No. 1 (M-1985-017) will be incorporated into <br />the permit area, it states in the mine plan and the legal description in Exhibit A, that <br />this site comprises approximately 38.3 acres, however in the introduction section of the <br />application and the Divisions records indicate that there should only be 36.1 acres in <br />the permit area. Please explain this discrepancy." <br />Applicant's Response: <br />The apparent 2.2 acre discrepancy is the result of two different legal descriptions; <br />however, for the purpose of the permit amendment the larger of the two areas (38.3 <br />acres) is included in the total permit amendment area and should be considered as the <br />correct area. <br />6. "Please state what depth the topsoil will be stripped and what depth the overburden <br />will be stripped. Please show where the topsoil piles and overburden stockpiles will be <br />stored for the remainder of the operation on the mining plan map... " <br />Applicant's Response: <br />The combined topsoil and overburden thickness ranges from 0.0 feet to a maximum of <br />17 feet with an average combined thickness of 8 feet. Typically, topsoil depths on the <br />subject property range in thickness from 1 to 3 feet with the overburden making up the <br />balance of the combined 8 foot thickness. Topsoil and overburden stockpile locations <br />are shown on the attached revised Mining Plan drawing (Exhibit D attachment number <br />4). <br />8/19/2009 2 <br />
