Stream Buffer Zones <br />Introduction <br />According to Rule 4.05.18, no land within 100 feet, or greater if required by the Division, of a <br />perennial stream, an intermittent stream, or an ephemeral stream with a drainage area greater <br />than one square mile, will be disturbed by surface and underground coal mining operations <br />unless the Division specifically authorizes surface or underground mining operations closer to, or <br />through such a stream. Additionally, the area not to be disturbed will be designated a stream <br />buffer zone and marked as specified in Rule 4.02.5 within the permit boundary. In accordance <br />with Rule 4.02.5, buffer zones established under the provisions of 4.05.18 will be clearly marked <br />at the New Horizon North Mine with signs indicating "Stream Buffer Zone". <br />Nysren Draw <br />As shown on Map 4.05.18-1, the drainage area for Nygren Draw is less that one square mile <br />(0.88 square miles). Therefore, Nygren Draw does not qualify for stream buffer zone protection <br />as defined by Rule 4.05.18. <br />Meehan Draw <br />A portion of the Pond NHN-003 South Ditch is proposed inside the stream buffer zone for <br />Meehan Draw as depicted on Map 4.05.18-1. However, WFC plans to redesign this pond and its <br />associated collection ditches and subsequently seek DRMS approval so that no disturbance <br />associated with Pond NHN-003 is proposed within the stream buffer zone for Meehan Draw. <br />In order to access reserves located north of Meehan Draw, temporary stream crossings must be <br />established within the buffer zone of Meehan Draw in the locations shown on Map 4.05.18-1. <br />Due to the minimal size of the disturbance associated with the temporary stream crossings, it is <br />not anticipated these crossings will cause or contribute to the violation of applicable water <br />quality standards. It is also not expected that during and after mining, the water quantity and <br />quality and other environmental resources of the stream will be adversely affected. Finally, the <br />temporary stream crossings will not create a temporary or permanent stream channel diversion. <br />Glasier Draw <br />As shown on Map 4.05.18-1, the drainage area for Glasier Draw is less that one square mile <br />(0.36 square miles). Therefore, Glasier Draw does not qualify for stream buffer zone protection <br />as defined by Rule 4.05.18. <br />Section 4.05.18 Page 1 Sept. 2015 (TR -11) <br />
