Dear Mr. Mathews:
In accordance with Regulations of the Colorado Mined Land Reclamation Board for
Coal Mining's Rule 4.03.2(1)(g)(ii), we do hereby request that Access Road 1A and a
portion of Access Road 1 be left in place subsequent to mining and reclamation
operations. These roads cross surtace lands owned by Snowcap Coal Company, Inc.
and are shown on attached Diagram 1. They will be used to access facilities on the
portal bench and to the storage yard on top of the Roadside refuse pile.
