(Amec Foster Wheeler) has prepared <br />this letter on behalf of Cripple Creek & Victor Mining Company (CC&V) in response to <br />comments provided by the Colorado Division of Reclamation Mining and Safety (DRMS) <br />regarding review comments of the above referenced draft letter dated January 29, 2016. Only <br />an electronic copy of this letter and attachments will be provided for resubmittal. DRMS <br />comments appear in italics followed by Amec Foster Wheeler's responses. The numbering <br />presented below corresponds to the comment numbering sequence provided by DRMS. <br />Report Text: <br />A. There are discrepancies in report documentation and the record of construction (ROC) <br />drawing causing uncertainty in exactly what portion of the liner is being certified: <br />i. The header in the report text and Diagram 1 on p. 2 imply the certified liner is from <br />"9,550 -foot Elevation Bench to Geomembrane Panel P1635". <br />Response: <br />The header in the report text and the legend callout of Diagram 1 on page 2 of the <br />report were not revised to the area for approval prior to submittal to DRMS and is <br />an error. Initially, the ROC report was going to encompass all of the liner deployed <br />up to Panel 1635, however, as the winter season was approaching, it was clear <br />that drain cover fill (DCF) placement would not be completed for the original <br />certification area. The ROC report was revised to certify the area in Figure 2 <br />(Attached). The Geomembrane Panel numbers are not in consecutive order for the <br />area outlined so a Figure was prepared to show the certified area for the title of the <br />report. <br />
