Sy X
The Maintenance Fee of $0.15 per ton of coal (GCC proposed $0.12) and the annual, automatic
escalation of the Maintenance Fee are not acceptable.
GCC provided documentation to the County substantiating that a Maintenance Fee of $0.12 per
ton of coal would cover Maintenance Costs for the foreseeable future. GCC understood that the
Manager of Public Works was going to review this information. If, after reviewing this
documentation, the County believes that $0.15 per ton of coal is necessary to cover the
Maintenance Costs, please provide documentation substantiating this amount.
GCC is willing to increase the Maintenance Fee in the future upon the County providing evidence
substantiating the actual Maintenance Costs. However, an automatic, unilateral increase that
may not actually be necessary is not agreeable.
GCC strives to operate at the highest levels of safety and integrity, and provide jobs to its employees and
economic benefits to the County. We continue to desire to work cooperatively with the County. We look
forward to discussing this with you further.
Very truly yours,
is Nance
Llvice President Energy & Environment
cc: Damian Peduto, Community Development Director
Sheryl Rogers, County Attorney
Adam Smith, Assistant County Attorney
Jim Davis, Public Works Director
Daniel Murray, Senior Planner
Brownstein Hyatt Farber Schreck
OD8999\0075\14405508.2
