COLORADO <br />Division of Reclamation, <br />A-17 Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />February 5, 2016 <br />Scott Wanstedt <br />Blue Mountain Energy <br />3607 County Road 65 <br />Rangely, CO 81648 <br />RE: Deserado Mine, Permit C-1981-018 <br />2015 4th Quarter Discharge Monitoring Report <br />Dear Mr. Wanstedt, <br />The Colorado Division of Reclamation, Mining and Safety (the Division) finds the Fourth Quarter 2015 <br />Discharge Monitoring Report for the Deserado Mine to be in compliance with the following Rules: <br />- Rule 4.05.13(2)(i) - Samples are measured accurately and record water quantity and quality <br />of the discharges from the permit area. <br />Rule 4.05.13(2)(ii) - SDH -3/5 (026-A, 026-W, and MN -26) and the Sewage Treatment Plant <br />(045-A) discharged during the fourth quarter of 2015. The samples from 045-A were below <br />the maximum allowable values or within acceptable value ranges. The SDH -3/5 <br />dewatering system had exceeded the acute WET standards in the Fourth Quarter DMRs. <br />The Division received the 60 day status update on January 15, 2016. The 60 day status <br />update states that the WET tests concluded on December 18, 2015. The test results showed <br />the samples continued to fail to meet the required parameters. The Deserado Mine will <br />continue to follow Part I.A.2.d of the CO -0038024 NPDES Permit to address the exceedances. <br />- Rule 4.05.13(2)(iii) - Discharge Monitoring Reports are received quarterly and filed with the <br />Division within 90 days of the sample collection. <br />The SDH -3/5 dewatering system was approved by the Division in Minor Revision 166 on October 16, 2015 <br />for an expansion of the dewatering system. <br />Please keep the Division informed of any decisions made by or discussions with CDPHE about the <br />exceedances at SDH -3/5. <br />This concludes the Division's review of the Fourth Quarter Discharge Monitoring Report.
