In a letter sent <br />on December 10, 2015 the Division found the SO applications incomplete. Based on a review of the above <br />referenced NOIs and the submittals by Peabody Energy, LLC, the Division has the following comments: <br />Division's Initial Completeness Comment: The Division currently holds Corporate Sureties for the above <br />referenced NOIs. No revised form of reclamation bond, which is to be substituted for the bond and surety <br />currently held was attached to the SO applications submitted. In order to determine that the applications <br />are complete, please submit a substituted bond and surety filed by the Successor for the Division's <br />review. <br />Peabody Energy, LLC's Response: Peabody Energy, LLC submitted repacement bond riders in order to <br />address the Division's Completeness Comment. <br />Based on the Peabody Energy, LLC submittal, the Division has the following comments: <br />X-1993-168-27 Bond <br />On Behalf changed from Peabody Coal Company to Peabody Western Coal Company <br />Bond Amount: From $7,425.00 to $4,579.30 <br />X-1987-168-20 Bond <br />On Behalf changed from Peabody Coal Company to Seneca Coal Company, LLC <br />Bond Amount: From $1,270.00 to $483.46 <br />X-1988-168-22 Bond <br />On Behalf changed from Peabody Coal Company to Seneca Coal Company, LLC <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us <br />John W.
