(NWCC)
on January 8, 2016. The report covers the fourth quarter 2015 monitoring period. The site was inspected
on December 31, 2015. According to the report no compaction tests were conducted. The report appears
to be in compliance with CDRMS Regulations 4.09.1(11) and 4.10.2(2), unless noted below.
The report was stamped by Brian Len a Colorado Registered Professional Engineer. The report was
received within two weeks after the inspection was conducted. According to the report, the upper haul
road to Areas 2, 3, and 4 of the refuse piles were inaccessible during the inspection. Based on the report,
NWCC did not observe any signs of instability, structural weakness or hazardous conditions at the pile.
Continued construction of the underdrain did not appear to have been conducted this quarter and was not
reported on. As a result, color photographs of the underdrain were not included with the report. The
seepage area at the toe of the northeast end of the refuse pile expansion area was inspected. The seep was
flowing, no signs of washout, slumps or slope instabilities were observed.
Three piezometers (RW#1, #2 and #3) were monitored monthly during this quarter. The report indicates
refuse coal was being stockpiled at the time of the site inspection. No compaction tests were taken by
NWCC in the new Expansion Area of the refuse pile this quarter. The Foidel Creek Mine permit requires
regular compaction testing for the quarterly refuse pile inspection report. Please explain why
compaction testing was not completed.
If you have any questions feel free to contact me at (303) 866-3567, extension 8120.
Sincerely,
Jared Ebert
Environmental Protection Specialist
,--6v qOZ6
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us
John W.
