NOTICE OF PROPOSED DECISION The Colorado Division of Reclama- tion, Mining and Safety proposes to approve Technical Revision Applica- tion No. 68 (TR -68) for the Roadside Portals (Permit No. C-1981.041), sub- mitted by Snowcap Coal Company, Inc. SCC is proposing to change the post -mining land use for former pond 8 from fish and wildlife habitat to commercial. The area is 0.5 acre in size and is adjacent to the agricul- tural commercial property Kokopelli Farm and Produce: The pre -mining land use of this area was commer- cial and it will be used to support the commercial agricultural busk ness. The Roadside Portals is alan under- ground coal mine located in Mesa County, approximately 5 miles N of Palisade, Colorado. Coal interest is federal and private, and the surface affected is federal and private land. The permit area encompasses ap- prpximately 2,786.00 acres. This proposed decision is based on a finding that the proposed opera- tion will comply with all require- ments of the Colorado Surface Coal Mining Reclamation Act, Section 34 33101, et seq., C.R.S., and the regu- lations promulgated thereunder. Copies of the proposed decision, in- cluding stipulations, are on file for public inspection at the Colorado Di- vision of Reclamation, Mining and Safety, Room 215, Centennial Build- ing,1313 Sherman Street, Denver, Colorado 80203. Persons with an in- terest that may be adversely affec- ted by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such re- quest must be made within ten (10) days of the initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the ob- jections to the proposed decision.
