January 28, 2016 <br />9 <br />AGGREGATE <br />INDUSTRIES <br />Mr. Tyler O'Donnell <br />Division of Reclamation Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Permit No. M-1999-034 — Cooley Reservoir and Fulton Wildlife Area <br />Status and Corrective Action Extension Request <br />Dear Tyler: <br />Mike Refer and I, Aggregate Industries' contractor and Sinclair representatives Jon <br />Brown and Tony Johnson met earlier this week to discuss flood restoration in the vicinity <br />of Sinclair's pipeline on Aggregate's land east of Cooley Reservoir. This pipeline was <br />abandoned a number of years ago when a new pipeline was installed at another location, <br />and since Sinclair has no plans at this time to put the line back in service, they have <br />removed the pipe and capped the ends. While Sinclair does not necessarily think they <br />will ever reinstall and use this pipeline, they are maintaining their easement and will <br />partner with Aggregate to get this area repaired. Jon Brown said that he would provide <br />the Division with an e-mail to that effect. <br />We would note that, while the area to be repaired around the pipeline is on land owned by <br />Aggregate, that parcel of land is not within the boundary of the Cooley Reservoir Fulton <br />Wildlife M-1999-034 permit. This work will therefore not be included in a technical <br />revision request. Aggregate will, however, proceed to coordinate with its contractor and <br />Sinclair to get the work scheduled, with the goal to have the work completed by April 1. <br />As Eduardo Moreno from City of Thornton advised by e-mail on January 15, Thornton <br />contacted FEMA for an opinion on the approach to have Aggregate perform the backfill <br />activities the Division is requiring to be completed this spring.
