Bax 670 <br />Hayden, CO 81639 <br />January 27, 2016 <br />RE: Yoast Mine; Seneca Coal Company <br />Third Quarter 2015 Sediment Pond Inspection Report <br />Annual Impoundment Certification <br />Permit C-1994-082 <br />Dear Mr. Nettleton, <br />The Colorado Division of Reclamation, Mining and Safety (CDRMS) received Seneca Coal Company's <br />third quarter 2015 sediment pond inspection report on September 29, 2015 for the Yoast Mine. The <br />Division finds the above reference report to be in compliance with the following CDRMS regulation. <br />4.05.9(17) — Examined at least quarterly by a qualified person designated by the operator, for <br />appearance of structural weakness and other hazardous conditions. <br />4.05.9(17) — A copy of the report shall be submitted to the Division on a quarterly basis. <br />The following sediment ponds were inspected on the respective dates: <br />Pond 010: 9/22/2015, the flume had been reinstalled at the time of the report. <br />Pond 10 spillway culvert is showing evidence of rust. <br />Pond 011: 9/22/2015. No problems were noted with this pond. <br />Stock Tank 011A: 9/22//2015, No problems were noted with this stock tank. <br />Pond 012: 9/11/2015, no problems were noted with this pond. <br />Stock Tank 012A: 9/11/2015, no comments were included for this stock tank. <br />Pond 013: 9/13/2015, No concerns were identified. <br />Pond 014: 9/11/2015, No problems were noted on the report with Pond 014. <br />ST -1: 9/22/2015, no problems were noted with this stock tank. <br />Based on the report, it appears that the impoundments inspected were functioning as designed at the time <br />of the inspection.
