AM W COLORADO <br /> Division of Reclamation, <br /> Mining(and Safety <br /> Department of Natural Resources <br /> 1313 Sherman Street, Room 215 <br /> Denver, CO 80203 <br /> January 21, 2016 <br /> Brian Watterson <br /> Twenty Mile Coal Company <br /> 29515 Routt County Road 927 <br /> Oak Creek, CO 80467 <br /> RE: Foidel Creek Mine; C-1982-056 <br /> November 2015 DMR Submittal Review(CO-0027154) <br /> Dear Mr.Watterson: <br /> The Colorado Division of Reclamation,Mining, and Safety(Division)has reviewed and found the above <br /> referenced reports to be in compliance with Rule 4.05.13(2)(a)(ii) and(iii). The Discharge Monitoring <br /> Reports for the above CDPS permit was received by the Division on December 22,2015. According to <br /> the DMR report submittal, Outfall 003A (Pond B) and Outfalls 005A/MON5 (Pond D)flowed during <br /> the month of November. The remaining outfalls listed in the report were reported to have not discharged. <br /> Two exceedances were reported for Outfall 003 for Total Suspended Solids(TSS) for both the thirty day <br /> average and seven day maximum. According to the report the increase in TSS may be the result of <br /> periods of precipitation/snow melt during the month. In order to address these exceedances,the report <br /> indicates an upstream boom across the water has been installed and that a baffle curtain system may be <br /> installed to increase residence time. The report indicates other alternative to address this issue are being <br /> explored by Twentymile Coal,LLC. <br /> Based on an MOU between the Division and the Water Quality Control Division(WQCD),the WQCD is <br /> responsible for the enforcement of CDPS permit conditions. In accordance with Rule 4.05.13(2)(ii) <br /> where an effluent limitation noncompliance has occurred,the person who conducts surface or <br /> underground mining activities shall forward the analytic results concurrently with the written notice of <br /> noncompliance. The Division received the DMR form with the analytical results of the sampling and a <br /> cover letter to Eric Mink with the WQCD providing the notice of noncompliance.
