Box 33695 <br />Denver, CO 80233-0695 <br />RE: New Horizon Mine, Permit No. C-1981-008 <br />2013 Annual Reclamation Report Review <br />Dear Mr. Gilbreath: <br />The Division of Reclamation Mining and Safety (Division) received the 2013 Annual Reclamation Report <br />(ARR) for the New Horizon Mine on March 17, 2014. The ARR requirements are found in Rule 2.04.13 of <br />the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. The Division has <br />finished its review and has the following comment about the 2013 ARR: <br />The bond release acres reported by Tri-State on the ARR form are not consistent with the acres <br />the Division has on file in the Permit System. As a third source of acreage tracking, the Division <br />conducted a review of all the New Horizon Findings documents. The Findings document review <br />generated a significantly different total for bond released acres.
