New Horizon Mine <br />B. Public Notice <br />Pursuant to the Rules and Regulation of the Colorado Mined Land Reclamation Board <br />published August 1980, and pursuant to the Colorado Surface Coal Mining Reclamation Act <br />34-33-101, et seq., notice is hereby given of the filing of an application for Phase I Bond <br />Release on a portion of the New Horizon Mine site. The application pertains to the New <br />Horizon Mine, Permit No. C-1981-008 (approved on 5/26/1983) by Western Fuels — <br />Colorado A Limited Liability Company, P. O. Box 628, Nucla, Colorado 81424, filed with the <br />Colorado Division of Reclamation, Mining and Safety (CDRMS), Colorado Department of <br />Natural Resources, 1313 Sherman Street, Room 215, Denver, Colorado 80203. The New <br />Horizon Mine is located approximately 2 miles west of Nucla, Colorado. <br />The Section 6 bond release areas were reclaimed in 2015 and encompasses 13.6 acres. The <br />Section 31 bond release area was reclaimed between 2004 and 2010 and encompasses 9.9 <br />acres. The status of the reclamation is consistent with the requirements of the approved <br />reclamation plan which included removing the overburden storage pile, regrading to the <br />approved post mine topography, and topsoil replacement. Listed below is a general legal <br />description of these areas: <br />In the N% & SE% ofSection 6, Township 46 North, Range 15 West and SW% of Section 31 <br />Township 47North, Range 15 West of the 6h P.M., County ofMontrose, State of Colorado. <br />New Horizon Mine currently holds a self -bond for $5,300,000, which covers the above listed <br />areas. With this application, New Horizon Mine will be requesting relinquishment of 60% <br />of the bond held for the Phase I parcels applied for under this application. <br />A copy of the bond release application is on file at the Montrose County Clerk and <br />Recorder's Office located in the Montrose County Associate Courthouse, 300 Main Street, <br />Nucla, Colorado 81424. <br />Written comments, objections, and requests for a public hearing or informal conference <br />concerning this bond release application should be addressed to the Colorado Division of <br />Reclamation Mining and Safety, Colorado Department of Natural Resources, 1313 Sherman <br />Street, Room 215, Denver, Colorado 80203. <br />Comments must be filed within thirty (30) days from the last date of this publication, or <br />within thirty (30) days of the completed inspection by the CDRMS, whichever is later. <br />SL -18 Phase I Bond Release Application Page 2 <br />
