(Tri-State), is the parent company to <br />Western Fuels -Colorado L.L.C., New Horizon Mine (New Horizon). Therefore, Tri-State on behalf of <br />the New Horizon Mine is notifying you that New Horizon is submitting an application for Phase I <br />performance bond release on areas reclaimed in 2015 and earlier. This application for Phase I bond <br />release will be denoted as SL -18. <br />This written notice is sent to you pursuant to Colorado Division of Reclamation, Mining and <br />Safety Rule 3.03.2(1). Prior to filing a request for the bond release, New Horizon must send written <br />notices of intention to seek bond release to adjoining property owners, surface owners, appropriate local <br />government bodies, municipalities, regional planning agencies, sewage and water treatment authorities, <br />and water conservancy and water conservation districts in the locality in which the coal mining operation <br />took place. This letter serves to comply with the required notification of New Horizon's intent to seek <br />bond release.
