Twentymile Coal, LLC <br />NM93 — Adequacy Review No. l <br />Page 3 <br />January 22, 2016 <br />information in the permit, an update to this section of the permit regarding mining is the Wolf <br />Creek Reserve is not appropriate. Please revise this section of the permit to remove citations and <br />discussion of the Wolf Creek Reserve. <br />Rule 2.03.9 — Personal Iniury and Property Damage Insurance Information <br />16. The applicant did not supply an updated copy of a certificate of liability insurance to be included <br />in Exhibit 3. The cover letter to MR293 indicates at the time of closing of the sale a revised <br />insurance certificate will be submitted. Prior to the approval of MR293 the applicant must submit <br />an updated insurance certificate meeting the requirements of Rule 2.03.9. <br />Rule 2.03.10- Identification of Other Licenses and Permits <br />17. For the Explosives Permit and the MSHA I.D. discussed on proposed revised page 2.03-44, <br />please provide the address of the issuing authorities. <br />Rule 2.07.7 — Conditions of Permits <br />18. Rule 2.07.7(9) requires continuous, uninterrupted bond coverage at all times and an adequate <br />bond amount must be maintained pursuant to the requirements of Rule 3.02.2. The cover letter to <br />MR293 indicates at the time of closing of the sale a revised bond will be submitted. Prior to the <br />approval of MR293, a new Performance Bond will need to be submitted by the applicant and <br />approved by the Division. <br />This concludes the Division's preliminary review of MR293. All of the above adequacy review items <br />will need to be addressed to the Division's satisfaction prior to approval of MR293. The Division is <br />required to issue a proposed decision on MR293 on February 1, 2016.
