Box 1430 <br />Palisade, CO 81526 <br />Re: Roadside Mine (Permit No. C-1981-041) <br />Technical Revision 68 (TR -68) <br />Adequacy Review Comments <br />Dear Ms. Hammond: <br />The Division of Reclamation Mining and Safety (Division) has completed its review of Technical Revision 68 <br />(TR -68) for Snowcap Coal Company's (SCC) Roadside North and South Mines. TR -68 was received by the <br />Division on December 18, 2015 and was deemed complete on December 22, 2015. <br />SCC is proposing to change the post -mining land use for the former pond 8 area from fish and wildlife habitat <br />to commercial/industrial. The pond 8 area had a pre -mining land use of industrial/commercial before it was <br />permitted as a coal mine. When the coal mine ceased operations, it was reclaimed as fish and wildlife habitat. <br />The area is approximately 0.5 acres in size and is adjacent to the agricultural commercial property, Kokopelli <br />Farm and Produce. Kokopelli plans to use the area to support the commercial agricultural business. <br />Mesa County submitted a letter to SCC on December 10, 2015 stating that they do not have objections with TR - <br />68. This letter will be incorporated into the permit upon approval of TR -68. <br />The surface owner, Brant Harrison, has submitted two letters to SCC stating that he approves of the provisions <br />of TR -68 and he wishes to waive the vegetation requirements of Rule 4.15.10(2). The Division has determined, <br />as per Rule 4.15.10(3), that revegetation is not necessary to control erosion on the former pond 8 area because <br />the area was compacted during reclamation, the topography is flat and no water runoff is directed to the area. <br />Mr. Harrison's two letters will be incorporated into the permit upon approval of TR -68. <br />The Division does not have any questions or comments about TR -68. <br />If you have any questions or need additional information, please contact me at (303) 866-3567 ext 8142. <br />Sincerely, <br />4a4 --L <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us <br />John W.
