<br />un January 2 t, Zu16, the Division of Reclamation, Mining and Safety (Division) approved amen d,,,e,,t
<br />application submitted to the Division on November 17, 2u15, addressing the following:
<br />The addition ora u.bz acre non-contiguous stockpile area adjacent to the mine site for a total
<br />permitted acreage of 8.76 acres.
<br />• Approved fo, ;nte, mittent status which requires less tnan 180 days of Annual Activity.
<br />The terms of the Amendment No. 1 (AM -1) app, owed by the Division are nereby incorporated into
<br />Permit No. M-2007-058. All other conditions and requirements of Pe► n,;t No. M-2007-058 remain in
<br />full force and effect.
<br />The a,ne„dment is being approved under the stipulation that the permittee will continue to operate
<br />under the existing damage agreen,e„t with Moffat County for Roads 1 & 2 RuW reatures and bridge.
<br />Tne permittee will adhere to the stipulations of the existing agreement and will not, u„ trucks weighing
<br />over the approved 85,uuu ibs. GVW rating for the above mentioned features. The permittee has until
<br />March 1, 2016 to p, ov;de the Division with a new damage agreement or a status update if an agreement
<br />cannot be reached.
<br />Approval of this amendment will satisfy the corrective action requ;red by the board order dated
<br />September 24, 2u15. Approval of this amendment will also abated all outstanding proble,,,a
<br />identified o„ the July 8, 2015 inspection report.
<br />In an effort to ensure the Fina,►tial Wa, ranty for the above referenced site adequately reflects the actual
<br />current costs of fulfilling the requirements of the approved reclamation plan, the Division has updated
<br />the reclamation cost estimate to include changed made through AM -1 (copy enclosed).
<br />The estimated liability amount or $39,260.00 exceeds the $16,06.00 Financial Warranty currently
<br />held for this site. If you have not already done so, please submit additional bona in the amount
<br />or $22,764.00. The revision will not be final until the bond is approved by the Division.
<br />Therefore pursuant to Section 34-32.3-117(4) of the Colorado Land Reclamation Acr, adequure
<br />Financial Wurranty must be submitted to the Division witnin 60 nays of the mailing late of this
<br />letter. The additional amount needs to be accepted prio, to Monday, March 21, 2ulb.
