Mr. Craig Lis Page 3 of 5
GSL Sand and Gravel SWSP
January 20, 2016
The current financial warranty posted for the site is $368,590, which was set by DRMS after
approving an amendment request to change the reclamation plan from water storage to an inert
backfill operation on the property (to two feet above the water table). This action satisfied the
requirement that the Applicant diligently pursue compliance with their DRMS permit and the
requirements described in the April 30, 2010 letter DRMS sent to all gravel pit operators (attached),
specifically in regard to the required financial warranty at the site. With each successive SWSP
renewal request, the Applicant shall demonstrate continued diligence in this effort, including
maintaining satisfactory status in obtaining proper bonds through DRMS.
Conditions of Approval
I hereby approve this substitute water supply plan, in accordance with Section 37-90-137(11), C.R.S.,
subject to the following conditions:
1. This SWSP shall be valid for the period of November 1, 2015 through October 31, 2017, unless
otherwise revoked, modified, or superseded by decree. A SWSP renewal request must be
submitted to this office with the statutory fee (currently $257) by September 15, 2017.
2. Well permit no. 57723-F is in good standing for the current use and exposed surface area at
the site in accordance with 537-90-137(2) and (11), C.R.S.
3. The total surface area of the groundwater exposed at the site must not exceed 16.05 acres
during the approval period of this SWSP, resulting in annual evaporative losses of 45.91 acre-
feet.
4. This SWSP does not permit any water use for dust control, aggregate production or any other
purpose, other than evaporation.
5. Total consumption at the site must not exceed the aforementioned amounts unless an
amendment is made to this plan.
6. Approval of this plan is for the purposes as stated herein. Any additional uses of this water
must first be approved by this office.
7. All releases of replacement water must be sufficient to cover all out-of-priority depletions in
time, place, and amount and must be made under the direction and/or the approval of the
water commissioner. The release of replacement water may be aggregated to maximize
beneficial use. The water commissioner and/or the division engineer shall determine the rate
and timing of an aggregated release.
8. All diversions shall be measured in a manner acceptable to the division engineer. The
Applicant shall install and maintain such measuring devices as required by the division
engineer for operation of this SWSP. In addition, the applicant shall maintain daily records of
all diversions, replacements, and the amount of water used for each particular purpose. The
applicant shall provide a report of these records to the division engineer
(Div1Accounting@state.co.us) and the water commissioner (Brent Schantz at
Brent.Schantz@state.co.us) on a monthly basis. The accounting must be submitted within 30
calendar days of the end of the month for which the accounting is being made and conform to
the Administration Protocol "Augmentation Plan Accounting, Division One - South Platte
River" (attached).
In addition, the applicant shall verify that the entity making replacements is identifying the
applicant's use specifically on the entity's accounting submitted to this office, and shall
claim credit only for actual amounts released as shown in the entity's accounting.
