This release request is for a total of 115.38 acres, leaving a total of 93.96 acres remaining in the mining permit boundary. Loveland Ready Mix concrete, Inc(LRM) is not requesting a reduction in the Financial Warranty. Attached are drawings showing the revised Mining and Reclamation Plans that identify the 115.38 acres LRM would like released from the Permit boundary. This 115.38 acres is land that has not been mined and will not be affected by mining or has already been reclaimed in accordance with the Permit requirements for wetlands mitigation. A majority of the acreage to be released, 99.52 acres, is owned by LRM and has continually been used as agricultural range land during the entire duration of the Permit. The north east corner of the release area owned by LRM and the entire release area owned by the Croissant Family Trust, 15.86 acres, has been successfully reclaimed to wetlands to meet the requirements of the Army Corps of Engineers Permit No. 200180205. Documentation from the Army Corps of Engineers, dated August 27, 2008, approving and releasing this area has been included with this submittal. We have included a copy of the Department of the Army Permit Decision Document, Corps File No. 200180205 and the last two Mitigation Monitoring Reports as further reference. All of the exposed water surfaces for this Permit have been augmented in Water Court Case CW2009CW105. A copy of this decree is also included with this submittal.
