Authority. <br />This decision document constitutes the Department of the Army, Corps of Engineers (Corps) Environmental <br />Assessment, Statement of Findings, Public Interest Review, and compliance determination under the National <br />Environmental Policy Act (NEPA). The review was conducted in accordance with procedures described at 33 <br />CFR Part 320 and Part 325, including Appendices B and C. This document also addresses the requirements <br />contained in the Environmental Protection Agency's Section 404(b)(1) Guidelines published at 40 CFR Part 230. <br />1.2. permit Decision. <br />My decision is to issue the Department of the Army permit with the inclusion of the conditions identified in this <br />document. <br />2. Project Information[33 CFR Part 325.2]. <br />2.1. Location. <br />The project is located southeast of Loveland, south and east of the junction of Weld County Roads 13 and 54. The <br />site is more specifically located in the North 1/2 of Section 30, Township 5 North, Range 67 West, Weld County, <br />Colorado. Attachment 1 shows a map of the site location. <br />2.2.Existing Conditions. <br />The aggregate mining project is located adjacent and just west of the Big Thompson River. No aspect of the <br />project will include fill, discharge, or excavation of any portion of the Big Thompson River channel or banks. <br />The site contains three types of jurisdictional wetlands; oxbow wetlands, sideslope seep wetlands, and toeslope <br />wetlands totaling 15.90 acres. The site also contains non jurisdictional wetlands described as artificially irrigated <br />wetlands, and an isolated oxbow wetland totaling 14.17 acres. Total area of all wetlands at the site is 30.12 acres. <br />Natural vegetation communities within the properties can be broadly categorized as sedge/rush swales, wet <br />meadow, and mixed grassland. The communities form a mosaic within the property and intergrade together <br />depending on microtopography, soils, and the ambient hydrologic regime.
